for setting up new higher education institutions, fee determination
I- Procedure for setting up new technical institutions
The proposal form for establishment of new technical institutions for
conducting technical programmes can be submitted by the following:
(a) Registered societies and trusts, company under section 25
(b) Central/state government institutions
(c) Government aided institutions
Approval process
To establish a new institution, the management should firstly get the
application from the AICTE through payment of the prescribed fees
(approximately Rs 5,000). The approval process for establishment of new
institutions is open ended, and the applicant society/ trust is allowed to
submit proposals to the concerned Regional Office of the council any time round
the year. The proposal for the new institution would be valid for 3 years.
The duly filled application should be submitted to the concerned
regional office of the AICTE in four copies along with the requisite processing
fee (Rs 50,000). A committee comprising two members of concerned Regional
Committee, including the Regional Officer as convener, will scrutinise this
application and communicate deficiencies if any to the applicant within 15 days
from receipt of the application. The completed proposal is then forwarded by
the regional office within 15 days to the concerned state government/union
territories and affiliating university for obtaining their views within 30
days.
The state government and the affiliating universities forward its views
within 30 days from the date of receipt of the proposal from the Regional
Office giving reasons and justification to substantiate their stand. The views
of the concerned state government/universities are taken into consideration
while processing the proposals for establishment of new technical institutions.
Accordingly, no separate No Objection Certificate (NOC) is required to be
submitted to the AICTE by the applicant society/trust from the concerned state
government/ university. However, the council has the right to overrule the
recommendations of the state government/university while deciding the matters
of establishment of new technical institutions.
A committee of the AICTE will then scrutinise the proposal, study the
recommendations of the state government or university, and then give
recommendations. Based on these recommendations, the AICTE will issue the
viability letter and physically verify the infrastructural facilities available
for establishing the institution. Final approval will be granted based on the
merit of the recommendations of the Inspection Committee. After getting the
approval, the management has to approach the University or State Board of Technical
Education for the affiliation.
Conditions for grant of approval by AICTE
The applications will be considered subject to the fulfilment of the
following conditions:

The financial position of the applicant should be
sound for investment in land and in providing related infrastructural and
instructional facilities as per the norms and standards laid down by the
council and for meeting the annual recurring expenditure

The courses or programmes should be conducted as per
the assessed technical manpower demands
·
The admission should be made according to the
regulations and directions of the council
·
The tuition and other fees should be charged within
the overall criteria as laid down by the council
·
The staff should be recruited as per the norms and
standards specified by the council
·
The governing body in case of private technical
institution should be as per the norms specified by the council
While these are the preconditions for grant of approval by AICTE, there
can be other conditions which would be specified by the council from time to
time.
While issuing a Letter of Viability, the council will ask the applicant
to submit the following documents:
(i) Deed of registration of
land relating to ownership/title of the applicant Society/Trust on the land
earmarked for setting up the new institution
(ii) A land use certificate from the authority
concerned
(iii) In case the applicant is running
any other educational institution and the new institution is purposed to be set
up in the same premises, an irrevocable resolution of the applicant stating
that sufficient area of the premises has been earmarked specifically for
setting up the proposed institution.
(iv) A fixed money deposit jointly in the
name of applicant society/trust and the Regional Officer of the respective
Regional Office for a period of 8 years (After 8 years, the applicant may apply
to the council to allow the funds to be used for development purposes of the
institutions). The accounts of the funds would be maintained by the Regional
Office.
(v) Documents regarding
furnished permanent building at least adequate for the first year classes on
the land specified
(vi) A master plan for the entire
institutional complex with the details of the plinth area, including area of
laboratories, class rooms, drawing halls, workshops, library, administrative
block, hostel etc. should be submitted along with the construction schedule
indicating estimated cost of construction involved.
(vii) A registered undertaking on
non-judicial stamp paper, stating that the institute will abide by all the
regulations, norms, guidelines and standards of the council.
The final decision of the council will be communicated to the state
government/UGC/the university/the directorate of technical education, as the
case may be, the regional office concerned and the applicant. If the
application is rejected, the applicant can make fresh application for any
subsequent academic year.
